Proposed amendments in Tracking and Monitoring of Cargo Rules, 2012

NOTIFICATION
(CUSTOMS)

S.R.O. 425 (I)/2020.- The following draft of certain further amendments, which the Federal Board of Revenue proposes to make in the Tracking and Monitoring of Cargo Rules, 2012, in exercise of the powers conferred by section 219 of the Customs Act, 1969 (IV of 1969), is hereby published for information of all persons likely to affected thereby and, as required under sub-section (3A) of section 219 of the Customs Act, 1969 (IV of 1969), notice is hereby given that objections or suggestions thereon, if any, may for consideration of the Board of Revenue be sent within seven days of publication of the draft amendments in the official Gazette. Any objections or suggestions which may be received from any person, before the expiry of the aforesaid period, shall be considered by the Federal Board of Revenue, namely:-

DRAFT AMENDMENTS

In the aforesaid Notification,-

(a) in rule 3,-

(i) in clause (v), the expression " in Model Collectorate of Customs (MCC) Preventive: shall be omitted ;

(ii) for clause (vii), the following shall be substituted, namely:-

"(vii) Licensing Committee" means a Committee comprising Director General of Transit Trade (Chairman), Director Transit Trade (HQs), Karachi, Director Transit Trade (Peshawar), Director Transit Trade (Quetta), Director Reforms and Automation

(Karachi), Collectors of Customs (Enforcement and Compliance, Karachi), (Appraisement and Facilitation, Port Muhammad Bin Qasim, Karachi), (Appraisement and Facilitation-East, Karachi), (Appraisement and Facilitation-West), Karachi, and Director of Intelligence and Investigation, FBR, Karachi or any other authority designated by the Board;";

(iii) in clause (viii), for the expression "No. 4 of 2007, dated 31st March, 2007", the expression "No. 03 of 2020, dated 17th April, 2020" shall be substituted;

(iv) in clause (x), for the expression "Collector, Model Collectorate of Customs (Preventive)", the expression "Director (HQs), Directorate General of Transit Trade," shall be substituted; and

(v) in clause (xi), after the word "various", the words "Directorates of Transit Trade or" shall be inserted;

(b) in rule 5, for sub-rule (2), the following shall be substituted , namely:-

"(2) Director Transit Trade (HQs), Karachi shall be the convener of the Licensing Committee and its headquarters shall be located in Directorate General of Transit Trade, Karachi. The Director Transit Trade (HQs), Karachi shall provide secretarial and other allied support required for functioning of the Licensing Committee.";

(c) in rule 6, in sub-rule (3), after the word "importers", the words " or exporters" shall be inserted;

(d) in rule 14, in sub-rule (1), after the word "various", the words "Directorates of Transit Trade or" shall be inserted;

(e) in rule 15,-

(i) for the words "Collectorates", the words "Directorates or Collectorates" shall be substituted; and

(ii) after the word "concerned", the words "Director Transit Trade or" shall be inserted;

(f) in rule 19,-

(i) in sub-rule (1), for the words "MCC Preventive" the expression "Directorate General of Transit Trade" shall be substituted;

(ii) in sub-rule (2), after the word "relevant", the words "Directorate of Transit Trade or" shall be inserted;

(g) in rule 20, in sub-rule (4), after the word "the" occurring for the third time, the words "Directorates of Transit Trade or" shall be inserted;

(h) in rule 23, in sub-rule (3), after the word "by", the words "Directors of Transit Trade or" shall be inserted;

(i) in rule 24, in sub-rule (1), after the words "any of the", the words "Director of Transit Trade or" shall be inserted;

(j) in rule 26, in sub-rule (3), after the word "the", occurring for the second time, the words "Directors of Transit Trade or" shall be inserted;

(k) in 29, in sub-rule (3),-

(i) after the word "the", occurring for the fourth time, the words "Director of Transit Trade or" shall be inserted;

(ii) before the word "Collector" wherever occurring, the words "Director or" shall be inserted; and

(l) after rule 32, the following new rule shall be added, namely:-

"33. Any function enumerated in these rules including mounting and un-mounting of tracking devices in the designated areas, whereof, the staff of the Directorate General of Transit Trade is not posted, shall be performed by the staff of the respective Enforcement and Compliance or Composite Customs Collectorate of jurisdiction.".
