Amendments (Rules 93, 96 & 99 of chapter VIII Customs Agents Licensing) of the Customs Rules, 2001

NOTIFICATION

S.R.O. 1322 (I)/2024.- The following draft of further amendment in the Customs Rules, 2001, which the Federal Board of Revenue proposes to make in exercise of the powers conferred by section 219 of the Customs Act, 1969 (IV of 1969), is hereby published for information of all persons likely to be affected thereby and, as required under sub-section (3A) of the said section 219 and notice is hereby given that objections or suggestions thereon, if any, may for consideration of the Board, be sent within fifteen days of publication of this Notification in the official Gazette. Objections or suggestions which may be received from any person, before the expiry of the aforesaid period, shall be taken into consideration by the Federal Board of Revenue, namely:-

DRAFT AMENDMENT

In the aforesaid Rules,

(1) in rule 93,-

(a) for sub-rule (1), the following shall be substituted, namely:-

"(1) The licensing authority shall put in place a mechanism to scrutinize the applications received and shortlist the eligible applicants. The final list of eligible applications shall be forwarded to Customs Academy of Pakistan (CAP) for arranging a qualification test by itself or through accredited public sector testing agency, approved and nominated by the Board to ascertain knowledge of the applicants in Customs law, rules and procedures and use of Web Based One Customs (WeBOC), Pakistan Single Window (PSW) and Computer literacy. A simulation test shall also be conducted to ascertain the aptitude of the applicant for WeBOC and PSW."; and

(b) for sub-rule (2), the following shall be substituted, namely:-

"(2) The examination shall be conducted, at least once a year, by the CAP or through any government educational institution or testing agency approved and nominated by the Board on the recommendation of the Director General CAP. Each applicant shall deposit a fee as prescribed by the Board on the recommendation of the CAP, for examination-related expenses in the respective account of the Director General, CAP.";

(2) in rule 96, in sub-rule (1), in clause (d), for the expression "Pakistan Customs Academy (PCA)", the expression "Customs Academy of Pakistan (CAP)" shall be substituted; and

(3) in rule 99, in sub-rule (1), for the words "Pakistan Customs Academy", wherever occurring, the expression "Customs Academy of Pakistan" shall be substituted.
